PublishBrain provides AI-powered marketing strategy analysis and recommendations for indie game publishers. The Service includes strategy generation, audience analysis, channel recommendations, content planning, and related features. All recommendations are generated using artificial intelligence and should be reviewed by humans before implementation.
You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration. You agree to notify us immediately of any unauthorized use of your account.
Certain features require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled at least 48 hours before the renewal date. We reserve the right to modify pricing with 30 days notice.
We offer a 14-day money-back guarantee on all purchases. If you are not satisfied with your purchase for any reason, you may request a full refund within 14 days of your purchase date — no questions asked.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display that content solely to provide the Service. AI-generated outputs are licensed to you for your business use, but we retain rights to use aggregated, anonymized data to improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED RECOMMENDATIONS ARE NOT GUARANTEED TO PRODUCE SPECIFIC RESULTS. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLISHBRAIN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless PublishBrain and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may cancel your account at any time. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.
These Terms shall be governed by the laws of the jurisdiction in which PublishBrainis registered, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits against us.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service or by email. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
